- § the EU/EEA if the operating air carrier of the flight concerned is a UK air carrier.
In which cases is there a right to compensation?
Any flight that arrives at its destination with a delay of at least 3 hours, is cancelled less than 14 days before arrival or is denied boarding is entitled to compensation, provided that the causes of the unforeseen event are attributable to the airline and fall within the scope of UK regulations. In exceptional circumstances, the airline is exempt from paying compensation.
Passengers departing from a UK airport, or flying to the UK from a non-UK airport on an EU/EEA or UK air carrier, as well as passengers flying to the EU/EEA from a non-EU/EEA airport on a UK air carrier, are protected under UK261 Regulation.
